Katy Perry and collaborators ordered to pay $2.78 million for copying Christian rap song - Fox News

Katy Perry and her collaborators at her record label have to pay $2.78 million after a federal jury found the pop star copied one of her hit songs.

The jury previously found that Perry’s 2013 hit “Dark Horse,” which spent four weeks at No. 1 on Billboard’s Hot 100 in early 2014 and was performed at the Super Bowl, copied a 2009 Christian rap song titled “Joyful Noise.”

It was an underdog victory for rapper Marcus Gray, a relatively obscure artist once known as Flame, whose 5-year-old lawsuit survived constant court challenges and a trial against top-flight attorneys for Perry and the five other music-industry heavyweights who wrote her song.

The amount fell well short of the nearly $20 million sought by attorneys for Gray and the two co-writers of "Joyful Noise" — Emanuel Lambert and Chike Ojukwu — but they said they were pleased.

"We weren't here seeking to punish anyone," said Gray's attorney, Michael A. Kahn. "Our clients came here seeking justice, and they feel they received justice from a jury of their peers."

Perry herself was hit for just over $550,000, with Capitol Records responsible for the biggest part of the award — $1.2 million. Defense attorneys had argued for an overall award of about $360,000.

Perry's attorney, Christine Lepera, said they plan to vigorously fight the decision.

"The writers of Dark Horse consider this a travesty of justice," Lepera said.

"Dark Horse," which combines elements of pop, hip-hop and trap styles, was a mega-hit for the Santa Barbara, California-born singer, with its call-and-response chorus of "Are you ready for (ready for), a perfect storm (perfect storm)?"

Gray, a native of St. Louis, sued later in 2014. His song of earnest and ebullient praise stood in stark contrast to the playful black magic evoked by "Dark Horse," and an early version of the lawsuit faulted Perry's song for tainting the sanctity of his.

The two-week trial had two phases: One about music, one about money.

Perry took the witness stand on the first day of testimony. She testified, as her co-writers would, that she had never heard of Gray or Flame or "Joyful Noise" until he sued.

She got a rare laugh from the courtroom when her attorneys were struggling with technical issues as they tried to play a part of "Dark Horse."

"I could perform it for you live," said Perry, who did not appear in court for the rest of the trial.

The jury heard testimony from musicologists on the disputed section of the two songs — a piece of the musical backing track that plays during the verses of "Dark Horse" and throughout almost all of "Joyful Noise."

While jurors were told to consider only those sections, they gave a surprisingly sweeping verdict Monday that held all six songwriters responsible for copying "Joyful Noise." That included Perry, who wrote only lyrics, her co-lyricist Sarah Hudson, and Juicy J, who only provided a rap verse for the song.

The instrumental track that was most at issue was created by Dr. Luke, Max Martin and Circuit.

During closing arguments earlier Thursday, Gray's attorneys said that because the relevant riff plays through 45 percent of "Dark Horse," the plaintiffs should get 45 percent of its earnings, including every album that included it. They put those overall earnings at $41 million, thus seeking nearly $20 million.

The defense argued that only fractions of the album earnings should count for the single song and that considerable promotional expenses paid by Capitol Records should be subtracted.

Gray's attorneys said those expenses were gratuitous, pointing out to jurors that they included $13,000 for a hairstylist for Perry for one awards show and nearly $2,000 for flashing cocktail ice cubes.

The nine jurors deliberated for two full days to reach their initial verdict but took just a few hours to decide on dollar amounts.

Perry's five co-writers were each given penalties to pay that ranged from about $60,000 for Dr. Luke to more than $250,000 for Martin.

The jurors decided that the instrumental riff the two sides were fighting over was responsible for 22.5 percent of the success of "Dark Horse" and handed out the awards accordingly.

The defendants' fight against the decision will begin immediately. U.S. District Judge Christina A. Snyder, who presided over the trial, will now consider a motion to throw out the case.

Lepera, Perry's attorney, said outside court that the plaintiffs presented no evidence of copyright infringement, no evidence that the songwriters had access to "Joyful Noise" and no evidence the songs that were substantially similar.

"The only matter in common is an unprotectable C and a B note, repeated," Lepera said. "We've been receiving outcry from people all over the world, including other musicologists."

If the judge upholds the verdict, the case will almost certainly head to an appeals court, where jury awards in similar cases have often been changed or thrown out in recent years.

We always love a good clapback and there is perhaps nothing more satisfying than a good mommy-shamer clapback. P!nk jumped to the defense of fellow musician and mom Jessica Simpson in epic fashion over her latest shamers and we are so here for it!

"I heard people were bummed on Jessica Simpson for letting her seven year old get her hair colored," P!nk wrote in a caption to her post. "So we thought we’d share what we did yesterday."

What they did yesterday was dye her daughter Willow's hair, which according to Simpson's trolls is the absolute worst and most irresponsible thing you can do as a parent. What in the heavens could P!nk be thinking? For shame!

P!nk is, of course, no stranger to mommy shamers, as it was just two weeks ago she had to defend allowing her kids to run around in a Holocaust memorial, and a week prior to that she hilariously shut down shamers preemptively in a picture of her daughter running through sprinklers.

"Here's a picture of my child running through water," she wrote on that picture. "It wasn't even filtered. What a waste of water. And no helmet? I hope she had sunscreen. If she slips and falls she may be traumatized for life. And her mother wasn't even there. I was...gasp...working!!!! In another country!"

Once again, it was what P!nk did in the hashtags of this latest post where she proved her true mastery of the clapback with several pointed jabs at the mommy shamers of the world ... and one final blow that they simply can't do anything about.

First, she told them #GetYourOwnKids, which is pretty good advice. After all, by their own reckoning they know absolutely everything about parenting, so who would be more qualified to raise children. Perhaps spend less time online shaming other moms and more time adopting kids so real kids can benefit from your genius.

But then again, P!nk also said -- and we broke down this hashtag for clarification purposes -- "parent police are actually just lonely said people." This is actually a very kind representation of those people who find some perverse pleasure in judging total strangers and telling them everything they're doing wrong as parents.

But the sweet revenge of the last hashtag is where she really hit it out of the park. "OhLookMaNoComments, she wrote. And she disabled comments on the post so not a single mommy shamer could even come at her. And that is how you do it!

Jessica Simpson posted a shot of her daughter with dyed ends two days ago and almost immediately the mommy shamers came after her. "Isn't she too young to have her hair dyed?" asked one follower. Another asked, "Why start ruining her hair so young?"

Still another took it to the next level and chastised Simpson, writing, "If you are giving her everything she wants, you may be raising a lil monster." That's just the tip of the iceberg, and as a reminder, this is over hair dye!

And for the record, the "Descendants"-inspired look is absolutely adorable on Max, and we're sure Willow is going to rock that electric blue, too. They're kids, they're having fun, and we love seeing P!nk support Jessica against the trolls.

And she offered some great advice for Jessica and any other moms who want to share their children's lives on Instagram. You can always just turn off the comments to silence those mommy shamers forever! All moms know that sometimes silence is golden.

Meghan Markle has difficulty with the ‘strict, traditional path’ of a royal life, claims biographer - Fox News

Settling into royal life in front of millions is far from easy.

Former American actress Meghan Markle officially became the Duchess of Sussex when she married Prince Harry in May 2018, and became a mom a year later, when the couple welcomed a son named Archie Harrison Mountbatten-Windsor. And while the 37-year-old is seemingly enjoying a fairy-tale existence, life behind palace doors hasn't always been smooth sailing.

“I think it’s very hard for her,” British journalist Angela Levin told Fox News. “I think she’s done brilliantly at some things. She’s marvelous when they are out and about. She’s very good at talking to people. It’s an awful lot to learn and she’s very energetic and keen. But it might be good for her if she took a little bit more advice. Before in her life, she was very used to making her own decisions. I do think it’s very difficult for her. This is a very strict, traditional path. It takes a while to get used to it.”

Levin, a veteran reporter on royal affairs, published a biography in 2018 titled “Harry: A Biography of a Prince,” which is based on her exclusive conversation with the 34-year-old at Kensington Palace before he married Markle. Levin had accompanied Harry on his many engagements and shadowed him for more than a year.

Most recently, Levin released a paperback version of her book, which takes a closer look at Harry’s marriage to the star. For her newest release, Levin had access to numerous sources who had insider knowledge of the couple.

“In the early stages, I don’t think the duchess really understood the difference between being a show business person and being a member of the royal family,” Levin explained. “Prince Harry was very anxious when we spoke originally and said he didn’t want to be thought of like a show business person. His feeling about being royal was that it was about duty, it was about helping the queen and that it was a very serious job. But the line has been a very narrow one, I think.”

Levin claimed that Markle received criticism from Harry’s friends over her modern, healthy lifestyle, which is believed he adopted since they met in 2016.

“I think that when people marry, they sort of slightly change so that they can work together as a team,” she explained. “There has been some criticism about her changing Harry. But I think she’s very confident… And he doesn’t mind at all. He is very, very proud of her. He’s actually in awe of her. He wants to be with her more than anything. His relationship with her is more important than anything.”

“Some of his friends were with him when he was heavily drinking, smoking and behaving like a bad boy,” Levin continued. “And he doesn’t want to do that anymore. He’s completely devoted to Meghan who is great into looking after yourself and keeping fit with yoga… He’s dropped a few people who just didn’t connect with her.”

Levin alleged that Markle’s eagerness to take on her royal duties didn’t sit well with some of the palace staff, who were already accustomed to a completely different approach.

“It’s been said she was emailing [her staff] at 5 a.m., but truthfully, I’m not sure how difficult that can be,” she chuckled. “People have left and they have talked. It is hard when you’re in such regal circumstances to know how to handle staff. That takes a bit of a while… The queen is also very, very polite to her staff and treats them extremely well with lots of courtesy. I’ve been told Meghan isn’t like quite like that and slightly gives orders. It’s a completely different life to settle into.”

Despite the challenges Markle may have endured, Levin stressed Harry has been incredibly supportive of his spouse.

“He’s thrilled he found someone he felt totally in love with,” said Levin. “He also understands it’s not easy for her. She’s given up her freedom. But it’s been an exciting time for both of them, especially with the baby. You’re running and you’re not going to look around you.”

While Markle has proven to be a breath of fresh air in the palace, Levin said the one rule she should avoid breaking is staying silent on personal political views.

“Royals are not supposed to say anything political at all,” Levin warned. “But most of all, when they’re out on a royal engagement. She has done this a few times. It caused a lot of concern. She doesn’t seem to fully understand the royal ways, which I think it’s absolutely understandable. But you also need to be a bit careful because we’re used to many traditions that perhaps are not so acceptable to someone who wasn’t born and brought up in a royal setting.”

As for what the future holds for the couple, Levin said Markle will continue to navigate life only life as a duchess but also life as a new mom in the public eye. Despite the challenges it will certainly deliver, Harry is determined to be by her side no matter what.

Meghan Markle Could Alarm Queen Elizabeth If This Starts to Happen - Showbiz Cheat Sheet

Things have not been easy for Meghan Markle this past year. After marrying into the royal family in 2018, she has been subjected to living under a microscope with negative reports about her published on a daily basis. Even as a new mother, the Duchess of Sussex cannot catch a break.

The royal family does not want another situation like Princess Diana

The 1980s and 1990s were a trying time for the royal family. Princess Diana married Prince Charles in 1981 and, for the next couple of decades, the family would be turned upside down.

Princess Diana went against a lot of traditions established by the royals before her. She was known to be quite rebellious and did not do anything that she did not agree with. Princess Diana ignored the royal readiness lessons given to her, chose to raise her sons in her own way, and became friendly to staff members instead of closed off like other royals.

Another thing that Princess Diana did differently was carved out a good relationship with the media. While she was in the middle of dealing with Prince Charles’ affair, she reached her breaking point and decided to go to the press to air out every issue she having as a royal.

The queen and other members of the royal family were no doubt embarrassed about what Princess Diana did. Reportedly, since Markle is struggling in the royal family as well, the last thing they want is for another drama like Princess Diana.

“They don’t want another Princess Diana-like situation where there’s a perception that Meghan is on the verge of breaking down,” a source told Best Life.

Meghan Markle’s recent behavior has “raised concern”

Unfortunately, the palace has been on edge recently due to some things that Markle did.

At the recent Lion King premiere, Markle showed that she might be fed up with the constant criticism about everything she does. When she was complimented about her marriage with Prince Harry, the Duchess of Sussex responded: “Thank you. They don’t make it easy.”

Before the premiere, Markle was seen at Wimbledon, where she donned a rather casual outfit and had a big section of the audience cleared out just for her. Several people also reported that Markle’s bodyguard stopped them from taking pictures of the match if Markle happened to be in the shot.

The insider with Best Life shared: “Meghan’s behavior in recent weeks has raised concern in the Palace. The Queen likely thought the Duchess had settled into royal life because she did so beautifully in those first months after the wedding, but she has a reason for concern given the events of these recent weeks.”

Can things get better for Meghan Markle?

The future is very hard to predict, but there definitely are signs that life in the royal family could get better for Markle.

For one thing, she already has the support of Queen Elizabeth. Royal insiders have shared that the queen is very happy with Markle, especially since the latter has a strong work ethic.

Additionally, it’s possible that much of Markle’s struggle now stems from the fact that she is very different from other royals and people are not used to having someone like her around. However, time could change all that. She already has a supportive fan base that believes in what she stands for, so it’s possible that over time much of the public and the media could grow to be more positive about her as well.

Hotel company rips apart 'Bachelorette' contestant in savage tweet - AOL

Whether or not you tuned into this week's two-night long finale of 'The Bachelorette,' it's safe to say that you were probably unable to escape the office banter and social media backlash that surrounded the show's winner-turned-villain, Jed Wyatt.

Quick recap: Hannah Brown chose Jed Wyatt, the couple got engaged and Hannah later found out that Jed had been lying the entire time and had a girlfriend back home that he planned on going back to once filming wrapped. 

When Brown confronted Wyatt, he claimed that he was 'just hanging out' with his girlfriend back home, Haley Stevens, despite the fact that the pair was throwing around the 'L' word and had spent the night together the day before Wyatt left for filming.

Suffice it to say, Bachelor Nation was not happy with Wyatt and his behavior.

Perhaps the best thing about reality television is that it bonds people -- it's able to connect people that otherwise  by giving us all something to talk about, even with big name companies or celebrities.

Hospitality site Hotels.com was not too pleased with Wyatt's actions and word choice during the show and subsequent finale and took it to Twitter to give Wyatt a unique offer he was sure to enjoy:

"BTW @jedwyattmusic we have some awesome hotels in the Bahamas," the tweet read, "Perfect for your next trip with someone you’re “only hanging out with'".

The tweet has since garnered over 160 retweets and 480 likes.

Earlier this month, Netflix chose to remove a graphic Season 1 sequence that depicted Katherine Langford’s Hannah taking her own life. The decision to alter the scene came in the wake of a new study that drew a connection between a spike in teen suicide and the popularity of the teen drama.
